Custody Law in Pakistan – A Legal Practitioner’s Perspective

In Pakistan, these matters are primarily governed by the Guardian and Wards Act, 1890, supported by the Family Courts Act, 1964. These statutes form the backbone of legal proceedings relating to care, upbringing, and guardianship of minors. The guiding principle in all such cases is the welfare and best interest of the dependent individual involved.

Custody is legally divided into two main aspects: legal guardianship and physical custody. Legal guardianship relates to decision-making authority concerning education, health, religious instruction, and overall well-being. Physical custody involves the responsibility for day-to-day care and supervision. Traditionally, under Islamic principles, mothers are entrusted with early nurturing responsibilities, particularly during the formative years, whereas the father is recognized as the natural guardian. However, the courts are not bound strictly by these traditions and have the discretion to deviate if the facts justify doing so.
